2. License and Permitted Use
Subject to your compliance with these Terms, Miss Humblebee's Academy grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for personal, family, classroom, school, library, or other authorized educational purposes, depending on your subscription or written agreement with us.
You may use the Services only in accordance with these Terms, your applicable subscription plan, and any separate written agreement you have with us.
Except as expressly authorized in writing by Miss Humblebee's Academy, you may not:
- copy, reproduce, modify, distribute, display, publish, sell, lease, sublicense, or exploit the Services or any portion of the Services;
- reverse engineer, decompile, disassemble, or attempt to discover the source code or underlying structure of the Services;
- scrape, data mine, or extract content, data, or metadata from the Services;
- interfere with the operation, security, or integrity of the Services;
- use the Services to build, train, improve, or support a competing product or service; or
- use the Services for unlawful, harmful, fraudulent, abusive, deceptive, or misleading purposes.
3. Subscriptions, Fees, and Payments
Certain features of the Services may require payment. By purchasing a subscription or paid feature, you agree to pay all applicable fees, charges, and taxes in U.S. Dollars.
Unless otherwise stated, subscriptions automatically renew at the end of the applicable billing period unless canceled before renewal. You authorize Miss Humblebee's Academy and its payment processors to charge your selected payment method for recurring subscription fees and any applicable taxes.
Except as required by law or expressly stated otherwise, fees are non-refundable. You are responsible for reviewing subscription details before purchase.
We reserve the right to change pricing, plans, features, or billing structures at any time. Any pricing changes will apply prospectively and, where required, after notice to you.
4. User Content and Submissions
The Services may allow you to submit prompts, lesson content, files, text, images, audio, video, feedback, comments, account information, child profile information, student information, and other materials ("User Content").
You retain any rights you may have in your User Content, subject to the rights you grant to Miss Humblebee's Academy in these Terms.
You represent and warrant that:
- you own or control all rights necessary to provide the User Content;
- your User Content does not infringe, misappropriate, or violate any third-party rights;
- your User Content complies with these Terms and applicable law; and
- you have obtained any necessary permissions, notices, consents, and authorizations required to provide the User Content.
You grant Miss Humblebee's Academy a non-exclusive, worldwide, royalty-free license to host, use, reproduce, store, process, modify, adapt, display, transmit, and otherwise use your User Content as necessary to provide, maintain, secure, improve, and support the Services, enforce these Terms, comply with law, and perform contractual obligations.
You may not submit User Content that is unlawful, defamatory, infringing, abusive, threatening, discriminatory, sexually explicit, harmful to children, deceptive, or otherwise objectionable.
5. AI Lesson Creator and AI Features
The Services may include one or more AI-assisted or automated tools, including an AI lesson creator, AI lesson drafting features, image generation, voice generation, audio generation, suggestions, recommendations, or related tools (collectively, the "AI Features").
The AI Features are intended to assist with educational workflow and content creation. They do not replace the judgment of a parent, guardian, educator, administrator, or other responsible adult.
You acknowledge and agree that AI-generated or AI-assisted output may be incomplete, inaccurate, biased, outdated, inaccessible, duplicative, misleading, offensive, not age-appropriate, not standards-aligned, or otherwise unsuitable for a particular child, student, class, or purpose. Miss Humblebee's Academy does not guarantee that AI-generated or AI-assisted output will be error-free, original, unique, non-infringing, fully accessible, legally compliant, or fit for any particular purpose.
All AI-generated or AI-assisted output must be reviewed, edited, validated, and approved by a responsible adult or authorized user before being shared with, assigned to, or used by any child or student.
You agree not to use the AI Features to submit, upload, or process:
- sensitive personal information about a child or student beyond what is reasonably necessary for an authorized educational purpose;
- student education records or personally identifiable information except as expressly permitted by your agreement with us and applicable law;
- health, diagnostic, therapeutic, or psychological information for clinical use or decision-making;
- unlawful, infringing, harmful, discriminatory, or abusive content; or
- content intended for high-stakes decisions regarding a child or student without independent human review.
Miss Humblebee's Academy may monitor, filter, restrict, refuse, suspend, or remove AI-generated or AI-assisted content at its discretion to protect users, children, students, institutions, the Services, or legal compliance.
6. Privacy and Child Protection
Your use of the Services is also governed by our Privacy Policy, COPPA Notice, and any applicable school, district, or institutional agreement.
If you are a parent, guardian, educator, school, district, or other authorized user providing information about a child or student, you represent and warrant that you have the legal authority to do so and that your use of the Services complies with applicable law, school policy, and these Terms.
You agree not to provide more child or student information than is reasonably necessary for the intended educational purpose.
7. Intellectual Property
The Services, including all software, technology, interfaces, workflows, lesson structures, design elements, trademarks, logos, graphics, compilations, content owned by Miss Humblebee's Academy, and other materials provided through the Services, are owned by or licensed to Miss Humblebee's Academy and are protected by intellectual property and other laws.
Except for the limited license expressly granted in these Terms, no right, title, or interest in or to the Services is transferred to you.
Miss Humblebee's Academy, its product names, logos, and related branding are trademarks or service marks of Miss Humblebee's Academy. You may not use them without prior written permission.
8. Acceptable Use and Prohibited Conduct
You agree that you will not:
- use the Services in violation of any law, regulation, school policy, or third-party right;
- impersonate another person or entity;
- access or attempt to access another user's account or data without authorization;
- upload malware, malicious code, or content that disrupts the Services;
- harass, threaten, exploit, or endanger any child, student, or other user;
- use the Services to create or distribute unlawful, deceptive, harmful, or abusive material;
- submit unnecessary personal information about children or students;
- use AI-generated output without responsible human review before use with children or students; or
- interfere with, disrupt, or circumvent any security, authentication, moderation, or access control measure.
9. Third-Party Services
The Services may include or rely on third-party tools, integrations, hosting providers, payment processors, analytics services, content providers, accessibility tools, AI providers, or other services.
Miss Humblebee's Academy is not responsible for the acts, omissions, products, services, content, or policies of third parties except as required by law. Your use of third-party services may also be subject to those third parties' terms and privacy policies.
10. Disclaimers
THE SERVICES, INCLUDING ALL CONTENT, AI FEATURES, GENERATED OUTPUT, CURRICULUM MATERIALS, DOWNLOADS, REPORTS, AND THIRD-PARTY INTEGRATIONS, ARE PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MISS HUMBLEBEE'S ACADEMY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, ACCESSIBILITY, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, MISS HUMBLEBEE'S ACADEMY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, FREE OF HARMFUL CODE, OR THAT ANY CONTENT OR AI-GENERATED OUTPUT WILL BE ACCURATE, COMPLETE, CURRENT, SAFE, UNIQUE, STANDARDS-ALIGNED, AGE-APPROPRIATE, OR ACCESSIBLE FOR EVERY USER OR DEVICE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MISS HUMBLEBEE'S ACADEMY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, OR PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF MISS HUMBLEBEE'S ACADEMY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO MISS HUMBLEBEE'S ACADEMY FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
12. Indemnification
You agree to defend, indemnify, and hold harmless Miss Humblebee's Academy and its officers, directors, employees, contractors, affiliates, licensors, and service providers from and against any claims, demands, actions, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:
- your use of the Services;
- your User Content, prompts, submissions, or AI-generated output;
- your violation of these Terms;
- your violation of any law, regulation, school policy, or third-party right; or
- your use of the Services with children, students, or educational records without proper rights, permissions, notice, authorization, or review.
13. Suspension and Termination
We may suspend, limit, or terminate your access to all or part of the Services at any time, with or without notice, if we believe that:
- you have violated these Terms;
- your use poses a risk to children, students, schools, other users, or the Services;
- your account has been inactive for an extended period;
- we are required to do so by law; or
- continued access would create legal, security, or operational risk.
Upon termination, the rights granted to you under these Terms will immediately cease.
14. Educational Purpose Only; No Professional Advice
The Services provide educational content and tools only. They do not provide legal, medical, mental health, psychological, diagnostic, therapeutic, or other professional advice. AI-generated or platform-generated content should not be treated as a substitute for professional judgment or professional services.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles.
To the extent any dispute is permitted to proceed in court, you agree that such dispute shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction and venue of those courts.
16. Changes to the Services and Terms
Miss Humblebee's Academy may modify the Services or these Terms at any time. If we make material changes, we will provide notice as required by law. Your continued use of the Services after the effective date of the updated Terms constitutes your acceptance of the revised Terms.
17. Miscellaneous
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
These Terms, together with any policies or agreements expressly incorporated by reference, constitute the entire agreement between you and Miss Humblebee's Academy regarding the Services, unless a separate written agreement between you and Miss Humblebee's Academy states otherwise.
Our failure to enforce any provision of these Terms is not a waiver of that provision or any other provision.
You may not assign these Terms without our prior written consent. Miss Humblebee's Academy may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, or by operation of law.

Users should not include sensitive personal information, unnecessary child information, or student education records in prompts unless expressly permitted by their agreement with us and applicable law. AI-generated output should always be reviewed by a responsible adult or authorized user before use with children or students.

We do not sell personal information.

- with schools, districts, educators, parents, or guardians, as applicable to the account structure and authorized use

Commitment to Accessibility
Miss Humblebee's Academy is committed to making its digital experiences accessible to as many learners, families, educators, and institutions as possible.
We strive to design, develop, and improve our Services in alignment with applicable accessibility standards and best practices, including WCAG 2.1 Level AA goals. Accessibility is an ongoing effort, and some content, features, or third-party components may not yet fully meet accessibility expectations in every circumstance.
We are currently in the process of updating our Voluntary Product Accessibility Template (VPAT). Our prior VPAT was completed in 2023, and the updated version is being prepared to reflect current product functionality and ongoing improvements.
